1. Acceptance of these terms

By using ZebraSnap you accept these terms. If you don't agree, don't use the platform. To create an account you must be at least 18 years old and have legal capacity to enter into contracts in your country of residence.

2. About the service

ZebraSnap is a sports photography marketplace that connects photographers with athletes and fans. Photographers publish and sell their photos; buyers find and purchase them for personal use through AI-powered search tools.

3. Your account

You are responsible for the information you register and for all activity from your account. Keep your credentials private and tell us right away if you detect unauthorized access. A single person or entity may not operate multiple accounts to evade limits or sanctions.

4. Photos: ownership and license

Photographers retain ownership and copyright of the photos they upload. By publishing them they grant ZebraSnap a worldwide, non-exclusive, revocable license to host, display, transmit, generate watermarked previews, index them with AI, and sell them within the platform. This license remains in effect while the photos are published and for a reasonable time afterwards to complete purchases and related legal obligations.

Only upload photos you have rights to. Upload only your own work or material you are authorized to publish.

5. Purchases and permitted use

When you buy a photo you receive a personal, non-exclusive license for private use: print it, store it, and share it on social media. Commercial use, resale, transfer to media outlets, or use in advertising is not permitted without express written authorization from the photographer. Removing the watermark from free previews or redistributing downloaded photos is prohibited.

6. Commissions

ZebraSnap charges a commission on each sale made through the platform. The commission depends on the photographer's active plan and is automatically deducted at the time of payout.

Current commission: 5% – 16% depending on the photographer's plan.

7. Payments and refunds

Payments are processed through Stripe. To receive payouts, photographers must complete Stripe Connect verification in their jurisdiction. Payment processing fees are absorbed by the photographer. Refunds are handled case by case according to our refund policy and applicable law.

8. Artificial intelligence features

ZebraSnap uses AI for facial recognition, bib number detection, and other search tools. These features are provided as is: they improve with use but do not guarantee perfect results. We don't use photographers' photos to train third-party models. To learn more about how we process biometric data, see the privacy policy.

9. Acceptable conduct

• You may not use ZebraSnap to upload or share unlawful, defamatory, violent, sexually explicit, discriminatory content or content that infringes third-party rights.
• You may not interfere with the platform, attempt to access restricted areas, evade usage limits, mass-scrape, ignore robots.txt files, or use unauthorized bots to extract photos or data.
• You may not impersonate another person, register false information, or resell access to your account.

10. ZebraSnap intellectual property

The brand, logo, site, code, AI models, and marketing materials are the property of ZebraSnap or its licensors. You may not copy, modify, or use them commercially without written authorization. Photos published on the platform remain the property of their respective photographers.

11. Rights infringement claims

If you believe a photo or other content published on ZebraSnap infringes your rights, write to us with the information needed to evaluate the claim (identification of the work, proof of ownership, URL of the content, and your contact details). We promptly remove content that clearly infringes rights and suspend accounts with repeat infringement.

12. Third-party links and services

ZebraSnap may link to or integrate with third-party sites and services (Stripe, social networks, mapping tools, etc.). We don't control those services and are not responsible for their content, availability, or policies. Your use of external services is governed by their own terms.

13. Communications

You agree to receive electronic communications related to your account, sales, purchases, support, and product news. You can disable marketing communications from your account settings. Operational communications (payments, termination, legal notices) cannot be disabled while you have an active account.

14. No warranties

ZebraSnap is provided as is and as available. We don't guarantee uninterrupted availability, absolute AI accuracy, indefinite file retention, or specific sales outcomes. We work to keep a stable service, but use is at your own risk.

15. Limitation of liability

To the maximum extent permitted by law, ZebraSnap is not liable for indirect, incidental, special, punitive, or consequential damages, nor for loss of profits, data, or reputation arising from use of the platform. Our total aggregate liability in any case is limited to the amounts you have paid us in the twelve months prior to the event giving rise to the claim.

16. Indemnification

You agree to hold ZebraSnap, its officers, and contributors harmless from third-party claims arising from content you publish, misuse of the platform, or breach of these terms.

17. Changes to these terms

We may update these terms when we launch new features, applicable regulations change, or we need to clarify rules. We will notify material changes by email or in-product before they take effect. If you continue using the platform after the indicated date, you accept the new version.

18. Suspension and termination

You can close your account at any time from your settings. We may suspend or terminate accounts that breach these terms, pose legal or security risk, or commit fraud. Before final termination we try to contact you and give you a chance to appeal, unless immediate closure is required for legal reasons.

19. Governing law

These terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, except where the user's local law provides otherwise and is mandatory.

20. General provisions

If any clause is found invalid, the rest remain in force. Failure to exercise a right does not imply waiver. You may not assign these terms without our consent; we may assign them to a successor entity. Claims must be filed within one year of the event giving rise to them, unless applicable law provides otherwise.
